 If the owners of SmokyMountainCabins4U.com are not able to provide the promised level of service for any reason, including, but not limited to fraud, negligence, acts of God, service outages, war,  acts of terrorism, or any other reason,  neither SmokyMountainCabins4U.com nor its owners can be held liable for any costs on your part, loss of revenue, or rental fees.

Owners should be aware of scam tactics where individuals pretend to show interest in your property, but may in effect plan to pay for the service with either stolen checks or  money orders, or may ask you to return some amount to them when they send you payment for more than your total rental rates.  You may recognize these tactics in emails where poor/broken English is used in emails.  Many times these type scams originate in foreign countries, where prosecution is difficult.  SmokyMountainCabins4U.com takes no responsibility for losses incurred by the owner in these or any other cases.

 Renters are responsible for insuring that the property they are renting is what they think it is. Renters should conduct their own research as it relates to any advertisement on SmokyMountainCabins4U.com.  The renter may want to request copies of all policies from the advertiser.  The renter should insist on a rental agreement and understand the refund and cancellation policy, and always speak with the owner by phone before sending payment.

 You may want to consider purchasing rental insurance and checking with the Better Business Bureaus.

Terms and Conditions to advertise on SmokyMountainCabins4U.com

1. Photographs, whether submitted electronically or on paper will be reproduced on our website as accurately as possible, given the limitations within our website to maintain a consistent appearance and display, as determined by us.
2. Photographs mailed to us will not be returned or maintained in our files after they are scanned into our system.
3. SmokyMountainCabins4U.com assumes no liability for lost or undelivered photos.
4. The property owner who submits photos is confirming that he is the owns all property rights to the property, that the photo accurately and fairly represents  the property, and that the photograph holds the copyright or the photo or has obtained permission form the copyright holder to use the photo.
5. The property owner will indemnify and hold SmokyMountainCabins4U.com harmless from any legal action from misrepresentation of photos submitted.
6. SmokyMountainCabins4U.com has the sole right to determine what hyperlinks to other websites are appropriate.  Any link can be refused by SmokyMountainCabins4U.com and can be removed at anytime solely at our discretion without notice to the owner.
7. Any service provided by SmokyMountainCabins4U.com at this time or in the future may be discontinued at anytime without notice, with no refund of fees.
8. SmokyMountainCabins4U.com reserves the right to change prices at any time, to charge for any service offered, to modify its refund policy or discontinue the website at any time, with no refund of fees.
9. SmokyMountainCabins4U.com does not guarantee that the website will be available any specified time periods and cannot guarantee any specific “uptime” percentage.
10. Under no circumstances will SmokyMountainCabins4U.com be liable for any loss of profit or damages to the owner due to errors on the website whether due to technical errors on our part or errors in information by the property owner.
11. The accuracy of information in guest books are the total responsibility of the owner and the owner affirms that the entries are genuine comments from guests who have stayed in the property, unless clearly indicated otherwise.
12. SmokyMountainCabins4U.com has the sole right to refuse to publish a property for any reason determined by us, or no reason at all.  SmokyMountainCabins4U.com may also cancel or delete any property solely at our discretion without notice to the owner.  As the property owner you agree to hold SmokyMountainCabins4U.com harmless and understand no refunds will be given.  Complaints about your lack of responsiveness to requests, double bookings of a property, lack of payment of obligations to SmokyMountainCabins4U.com, or you engaging in unethical business practices as routinely accepted by the vacation rental industry are some examples, but not limited to the above, for removing your property without refund and without notice.
13. All payments must be made by credit card, debit card or check drawn on a U.S. bank, and must be made in U.S. Dollars.
14. Links to other websites are allowed solely at SmokyMountainCabins4U.com’s discretion.  SmokyMountainCabins4U.com may change is policy for allowing outside links at any time and may chose to remove your link if it points to properties in the area advertised that is not advertised on our site.  Also, any link to adult sites, sites containing pornography, and competing sites will not be allowed.  This determination is made solely by SmokyMountainCabins4U.com.
15. Property is advertised on SmokyMountainCabins4U.com as one property in one location.  If you sell the property on your listing and buy another one in the same area, you may list you new property for the remaining duration of your agreement with us.  Properties purchased in new locations will require another listing.
16. Property listings should not be sold to others unless the property itself is sold at the same time to the same purchaser of the listing.
17. Listings on SmokyMountainCabins4U.com are sold for the duration selected by the owner at the time of listing.  No refunds are given for removal or cancellation of the listing before the end of the duration initially selected, even if the listing is removed based on the owner request.
18. At the owners request the property listing can be temporarily inactivated and reactivated at a later date.  This does not extend the length of time the property will be listed.  The original termination date/renewal date will remain in effect.  No discounts or refunds will be given for this inactive period.
19. Property owners are solely responsible for adhering to all local rules, regulations, and restrictive covenants including taxes, licenses and safety requirements.
20. Information submitted and posted on SmokyMountainCabins4U.com becomes the sole property of SmokyMountainCabins4U.com and may not be copied or duplicated in any way without written permission of SmokyMountainCabins4U.com.
21. Only one property can be advertised per listing.  If a property has multiple rental units on the same site, additional advertising units must be purchased.  The rates for multiple rental unit property listings are subject to change and are based on factors such as location and number of rental units.
22. SmokyMountainCabins4U.com reserves all rights to determine layout and design of website, including photo display, functionality and placement of information. We will edit photos in order to present in a layout and design that is determined by us.  Any changes to the website can be made by us without notice.
23. SmokyMountainCabins4u.com has full authority to use any photos posted by owners to promote SmokyMountainCabins4u.com in both online and print media.
